It is often said that lawyers are exploitative and unfair people. This office came to erase this stigma. The entire staff there is lovely, and they do their job faithfully. In my case, I dealt with Attorney Hussam Armali, and I must say that I have never met such an honest, decent, and goal-oriented person. Thank you very much from the bottom of my heart 🙏
Rami Payment Demand Unauthorized Use Moshav Estate

Israel Land Authority (ILA) may in some cases require payment for nonconforming use of aggregate holding, especially when the actual use is not appropriate for the purpose of the land, the settlement agreement, the building permit, or the approvals granted to the rights holder. The requirement may come as a result of an inspection, application for the transfer of rights, sale, the series in front of an association or information provided to Israel Land Authority (ILA) under a different procedure.
In such a situation it is important to check the requirement in the frameworkEscorts in front of Israel Land Authority (ILA) and Cooperative Association in Agricultural HoldingsAt the same time examine the aspects ofAgricultural holdings, agricultural moshavim and farmsand fromPlanning and constructionIf the use is related to an unregulated structure, read the manual as well.Illegal housing unit in agricultural holding before sale.
The short answer
Yes, Israel Land Authority (ILA) may require payment, usage fee, overpayment, cessation of use or series if aggregulural holding is used that is not permitted under the rights documents. But simply accepting a requirement does not mean that the amount is correct or that there is no way to obtain, regulate or reduce the exposure.
The first test is not only what is written in the requirement letter, but what is actually done on the ground: is it a warehouse that has become a business, renting a building to a third party, commercial use of a residential home, an additional housing unit or a changed agricultural activity. The situation is then compared to an agreement with Israel Land Authority (ILA), for a permit and for the Association documents.
What is considered nonconforming use in agricultural holding
Nonconforming use in agricultural holding can be a non-agricultural use of a structure designed for agriculture, operating a business in a place of residence, renting buildings to third parties, commercial storage, B&Bs, an unregulated housing unit or the use of a structure without adjustment to a permit. Sometimes the structure itself has existed for years, but the changed use is what creates the problem.
An early warning sign is a situation in which income from the agricultural holding is not derived from agricultural processing or permitted residence, but from business activity, rental or other untested use vis-à-vis Israel Land Authority (ILA) and the local committee. A general answer such as "everyone does it in the moshav" is not sufficient if an official requirement is accepted.
When does the demand usually arise?
- Prior to the sale of agricultural holding, Israel Land Authority (ILA) checks the status of actual rights and uses.
- When requesting the transfer of rights within the family or registering a successor child.
- Where the association or local authority communicates information about business use or unusual structure.
- Following a field audit, photocopy, complaint or planning enforcement procedure.
- When the rights holder requests a permit, a split, series or other authorization and raises the issue himself.
- At the stage where a buyer or bank requires documents and the gap between the territory and documents is revealed.
What documents to check
The documents are the basis for dealing with the demand for payment. You should check the slot agreement or lease documents, the rights approval, the relevant Israel Land Authority (ILA) decisions, the Association documents, building permits, admissibility, the building portfolio, zoning, prior notices and any correspondence with Israel Land Authority (ILA) or the local committee.
In practice, it is precisely the document that seems marginal that sometimes interrupts the treatment. For example, an old scratch that shows an agricultural structure, while on the premises the building is leased to an office; or a union letter that authorizes companies but does not approve the commercial use that the agricultural holder relied on.
How to check if the amount is correct
It is not worth paying a demand just because it came from an official body. One should check on what period it is based, what use was attributed to agricultural holding, what area of the structure, whether it is continuous or point use, whether other charges have already been paid, and whether Israel Land Authority (ILA) has addressed all the relevant data.
It can sometimes be shown that the use has been discontinued, that the area is smaller, that the period is shorter, that the requirement refers to another structure or that there is a suitable series route. In other cases the dispute is not about the actual charge but rather about its height, manner of calculation or the conditions for further handling the transaction.
What to do before you pay
- Requesting the breakdown of the calculation and legal basis for the requirement.
- Compare the alleged use of the letter with the actual use of the territory.
- The Israel Land Authority (ILA) documents are reviewed, the Association and the local committee before any undertaking.
- Check if there is a possibility of a settlement, cessation of use, or overhaul.
- Assess the impact on sale, transfer of rights or bank financing.
- Beware of signing a document admitting unchecked facts.
How does it affect the sale of agricultural holding
A payment requirement for nonconforming use can delay the sale of agriculural holding, because a buyer will want to know who is paying, whether the use will continue, whether there is further disclosure and whether Israel Land Authority (ILA) will approve the transfer of rights. If the requirement is discovered after signing, it can become a dispute over breach of declarations, price reduction or payment delay.
Before a transaction one must decide whether the seller arranges the demand in advance, if part of the consideration remains in trust, if the buyer receives the agricultural holding without the same use, or if the transaction is conditional on obtaining a permit. Without such a mechanism, payment to Israel Land Authority (ILA) can become a barrier that manages the entire transaction.
Common Mistakes
A common mistake is to assume that years of use will not generate a charge. In practice, prolonged use does not necessarily become permissible, and sometimes it actually increases exposure to retroactive payment. Another mistake is to rely on the oral consent of a party in the moshav without checking the position of Israel Land Authority (ILA) and the local committee.
A third mistake is to pay quickly to "close an issue" before realizing what it means. Payment can be beneficial if it is part of the series right, but it may also be considered as an admission in a factual situation or leave open additional unmet requirements.
When to seek counselling
Seek advice immediately upon receipt of a payment requirement, before replying to the Israel Land Authority (ILA) and before signing an agreement to sell or transfer rights. At an early stage, it is possible to collect documents, check the basis for billing, and build a response that separates what is agreed and what requires inspection.
If there is also a procedure with an association, local committee or potential buyer, it is important to coordinate between all channels. One requirement of Israel Land Authority (ILA) can affect contract, planning, taxation and financing, and therefore it is not correct to treat it as a technical matter only.

I contacted Karen just to figure out whether it was worth selling a piece of land we inherited or keeping it. She sat down with me and explained the whole picture – rights, taxation, what can be done in the future. She didn’t try to push in a certain direction, and that was the most important thing to me.
Karin Amsalem, a professional and thorough attorney of the highest level! Represented us in the process of selling a plot of land that we won in a tender. This is a complex process that includes registering lease rights in the Land Registry, payments to the Land Registry such as consent fees, refunding subsidies for housing and construction, as well as handling the appreciation tax, which includes many expenses. Karin managed the entire process with professionalism, accuracy and attention to detail, while fully protecting our interests as sellers. Throughout the entire process, we felt that we had someone to trust. Highly recommend her!
