How Is Israeli Land Appreciation Tax Calculated When Selling an Inherited Apartment?

An apartment received by inheritance is not automatically exempt from Israeli Land Appreciation Tax (Mas Shevach). A specific inheritance exemption may apply, but if one of its conditions is missing, the heirs should examine another exemption route or calculate the taxable gain using the deceased's acquisition data, the sale price and recognized expenses.
This review should take place before the sale agreement is signed. Once the heirs have committed to a price, payment schedule and distribution of proceeds, an unexpected tax liability can leave insufficient funds to complete the transaction or trigger a dispute among the heirs.
The short answer
The first question is whether the specific inherited-apartment exemption under section 49B(5) of Israel's Real Estate Taxation Law applies. If it does not, the review moves to the deceased's relevant acquisition date and value, documented expenses and the share sold by each heir.
The Israel Tax Authority describes three principal cumulative conditions: the seller is the deceased's spouse, descendant, or spouse of a descendant; the deceased owned only one residential apartment before death; and the deceased would have qualified for an exemption had the apartment been sold during the deceased's lifetime. An inheritance order or probate order alone therefore does not establish the exemption.
When may an inherited apartment qualify for an exemption?
The exemption is intended to place an eligible heir, to a limited extent, in the deceased's position. It is not a general exemption for every asset transferred by inheritance. Both the heir's identity and the deceased's position immediately before death must be reviewed.
- The selling heir falls within the family relationship defined by law.
- The property is a qualifying residential apartment rather than land, a shop or another business asset.
- The deceased owned only one residential apartment before death.
- The deceased could have sold that apartment under an exemption.
- The transaction and exemption request are reported through the correct route and on time.
An early warning sign is incomplete information about other property rights held by the deceased. A share in another apartment, a family property or a right recorded through a housing company may not appear in the land-registry extract being reviewed. The complete ownership picture should be mapped before relying on the exemption.
What happens when the exemption conditions are not met?
Failure to meet the inheritance exemption does not necessarily mean that the entire sale proceeds are taxable. Another exemption, including a possible single-apartment route, may be available. Alternatively, the transaction may be taxable but the taxable gain may be substantially lower than the simple difference between the current sale price and an old historical figure.
A preliminary calculation should therefore be completed as part of Israeli real-estate tax and Land Appreciation Tax advice. The result may depend on the relevant acquisition date and value, ownership periods, property classification, building rights, depreciation where applicable, and expenses that are deductible under the law and supported by evidence.
How are the acquisition date and value determined?
For tax purposes, the decisive date is not necessarily the date on which the heir received the inheritance order. Depending on the date of death and the applicable statutory provisions, the deceased's acquisition date and acquisition value may remain relevant. For older apartments, that history can materially affect the calculation.
The heirs should look for the deceased's original purchase agreement, prior tax declarations, assessments and documents relating to family transfers. Missing records should not be replaced with an invented purchase price or an oral estimate. Available authority records, registration documents and alternative evidence must be examined.
Which expenses may reduce the taxable gain?
Where the sale is taxable, recognized expenses may reduce the gain if they are connected to the property, permitted by law and adequately documented. A family recollection that the parents invested substantial sums in the apartment is not, by itself, a substitute for evidence.
- Legal fees and brokerage fees connected to the relevant purchase or sale.
- Purchase tax paid in the relevant acquisition transaction.
- Documented capital improvements that were not deducted elsewhere.
- Betterment levy and certain payments connected to rights in the property.
- Other expenses allowed by law after reviewing the invoices and their connection to the transaction.
If receipts are missing, see what to do when renovation receipts are unavailable before an apartment sale. The aim is not to assume that every expense will be recognized, but to collect the strongest available evidence before filing the self-assessment.
What changes when there are several heirs?
When siblings or other heirs sell together, each seller's share, requested exemption route and allocation of the proceeds must be identified. A single sale agreement does not necessarily turn all sellers into one taxpayer. The inheritance order, registration, agreement and actual allocation should be consistent.
Disputes often arise when one heir paid property expenses, another lived in the apartment, or the family wants to distribute the proceeds differently from the shares stated in the inheritance order. Must the inheritance be registered before the apartment is sold?
A separate registration long before the transaction is not required in every case, and the inheritance registration and transfer to the buyer can sometimes be coordinated. Nevertheless, valid inheritance or probate documents, consistent ownership records and a viable registration path for the buyer are essential. A financing bank, housing company or the Israel Land Authority may impose additional requirements.

Which documents should be prepared for the tax review?
- The inheritance order or probate order and any estate-distribution agreement.
- A current Land Registry extract, rights confirmation or housing-company records.
- The deceased's purchase agreement and the tax declarations or assessments from that transaction.
- Documents concerning any additional apartments or property rights held by the deceased.
- Invoices and receipts for acquisition, improvement and sale expenses.
- Each heir's share and any family agreement concerning distribution of the proceeds.
The Israel Tax Authority's real-estate taxation portal provides forms, guidance and self-assessment tools. A transaction must still be reported within the statutory period even when an exemption is requested.
Mistakes to avoid before signing
- Assuming that every inheritance is exempt without checking how many apartments the deceased owned.
- Agreeing on distribution of proceeds before reviewing each seller's ownership share and tax position.
- Ignoring the deceased's acquisition history because the heirs did not pay for the apartment.
- Committing to payment dates without reserving funds for tax and registration approvals.
- Selecting an exemption route in the filing without comparing available alternatives.

When should legal and tax advice be obtained?
The review should preferably be completed before the apartment is marketed or a binding offer is accepted, and certainly before signing. Early advice is particularly important when the deceased held additional rights, old documents are missing, several heirs are involved, the property includes building rights, or the family plans to distribute proceeds differently from the inheritance order.
