What is a warning and why is it so important?

A warning note is one of the main legal tools in real estate transactions in Israel. When a seller-buyer agreement is signed, it is customary to write a warning note in Israeli Land Registry to inform the whole world that there is a commitment to make a transaction on the property.

The purpose of the comment is to prevent a situation in which the seller will sell the same property to another person, or register additional liens on it after signing the contract.

What does the warning note do?

When a warning note is recorded in Israeli Land Registry, it creates a sort of "warning flag" in the land registry. Anyone who inspects the property can see that there is a commitment to the transaction.

This means that the seller cannot make a conflicting transaction with another buyer, and banks or third parties will see that the rights in the property have already been promised to the buyer.

What does the warning not resolve?

Despite its importance, a cautionary note does not constitute a full protection against all risks in a real estate transaction.

For example, it does not protect against building irregularities, municipal debts, planning problems or problems with the seller's property rights.
